Agreement to Terms

By accessing or using https://denebluxury.com (the “Site”) and purchasing products from Deneb Luxury (“Company,” “we,” “us,” “our”), visitors and customers (“user,” “customer,” “you”) agree to be bound by these Terms and Conditions and all referenced policies. If these terms are not accepted, the Site must not be used and no orders placed.

Eligibility and Account

Eligibility

By using the Site, the user represents being at least 18 years of age or using the Site under the supervision of a parent/guardian.

Account

Users are responsible for maintaining the confidentiality of account credentials and for all activities under the account. Notify us immediately of any unauthorized use.

Accuracy

Users agree to provide accurate, current, and complete information during registration and checkout, and to keep details updated.

Products, Pricing, and Availability

Descriptions

We strive to display products, images, and colors accurately; minor variations may occur due to screen settings, photography, or manufacturing tolerances.

Pricing

Prices are listed in INR and include applicable GST unless stated otherwise. We may modify prices, offers, and availability at any time without prior notice.

Errors

In case of pricing or listing errors, we may cancel or revise orders. If payment was captured, a full refund will be issued on cancellation.

Orders and Acceptance

Offer and acceptance

Placing an order is an offer to purchase. Order confirmation does not constitute acceptance. Acceptance occurs when the order is dispatched and an airway bill (AWB) is generated.

Verification

We may verify identity, address, and payment details and may cancel orders suspected of fraud, abuse, or policy violations.

Quantity limits

We may limit or cancel quantities per person, per household, or per order at our discretion.

Payments

Methods

We accept major cards, UPI, net banking, wallets, and other payment methods shown at checkout.

Authorization

By submitting payment, the user authorizes us and our payment processor(s) to charge the full order amount, taxes, shipping, and any applicable fees.

Security

Payments are processed via secure third‑party gateways. We do not store full card details on our servers.

EMI/BNPL

If available, these services are provided by third parties and are subject to their terms.

Currency

All charges are in INR unless otherwise stated.

Shipping and Delivery

Processing time

Orders are processed within 1–2 business days after payment confirmation, excluding Sundays and public holidays. Orders received after 2:00 PM IST process the next business day.

Delivery windows

Standard delivery typically takes 2–5 business days for metro cities and 3–7 business days for non‑metro/remote locations after dispatch. Timelines are estimates and may vary.

Fees and thresholds

Standard shipping fee is ₹75.00 on orders below ₹1,000.00. Free standard shipping applies to prepaid orders over ₹1,000.00.

Risk of loss

Risk passes to the customer upon delivery to the address provided or to the person available at the address. Title transfers upon full payment.

Cash on Delivery (COD)

Availability

COD serviceability depends on PIN code eligibility and may be restricted.

Charges and limits

COD fees and order value limits may apply if COD is enabled.

Refusals

Repeated COD refusals/no‑shows may lead to account restrictions and recovery of two‑way shipping costs.

Returns, Replacements, and Refunds

Condition

Items must be returned unused and in original condition with tags, packaging, and any freebies where applicable.

Refund method

Approved refunds are processed to the original payment method or as store credit, as specified in the policy. Shipping/COD fees are generally non‑refundable unless due to our error.

Cancellations and Order Changes

Pre‑dispatch

Address changes or cancellations may be accepted within 6 hours of order placement or before AWB generation, whichever is earlier.

Post‑dispatch

Orders cannot be cancelled after dispatch. Rerouting is subject to courier capability and may incur a fee.

Promotions, Coupons, and Credits

Usage

Promotional codes, coupons, and credits are single‑use, non‑transferable, and subject to stated terms and expiry dates.

Abuse

We reserve the right to invalidate or refuse benefits in cases of misuse, fraud, or policy violations.

Intellectual Property

Ownership

All content on the Site, including text, images, logos, graphics, videos, software, and design elements, is our property or licensed to us and protected under applicable IP laws.

Limited license

Users are granted a limited, non‑exclusive, non‑transferable license to access and use the Site for personal, non‑commercial purposes. No content may be copied, reproduced, or exploited without prior written consent.

Acceptable Use

Users agree not to:

Violate laws or infringe third‑party rights.
Upload malicious code, scrape, or attempt to gain unauthorized access.
Interfere with Site functionality, security features, or other users’ experience.
Use the Site for fraudulent activities or to disseminate spam.

User Content and Feedback

Responsibility

Users are responsible for content submitted (reviews, comments, feedback). Do not submit unlawful, defamatory, obscene, or infringing content.

By submitting content, users grant us a worldwide, royalty‑free, perpetual license to use, reproduce, modify, publish, and display such content in connection with our business.

Moderation

We may remove or edit content at our discretion.

Disclaimer of Warranties

We do not warrant uninterrupted, timely, secure, or error‑free operation, or accuracy of content.

Limitation of Liability

To the maximum extent permitted by law, in no event shall we be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, revenue, data, or goodwill, arising from or related to use of the Site or products. Our total aggregate liability for any claim shall not exceed the amount paid for the product giving rise to the claim.

Indemnity

Users agree to defend, indemnify, and hold harmless the Company, its directors, officers, employees, agents, and affiliates from and against claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to: (a) user’s breach of these Terms; (b) user content; (c) violation of law or third‑party rights; or (d) misuse of the Site.

Force Majeure

We are not liable for delays or failures caused by events beyond reasonable control, including natural disasters, acts of God, war, terrorism, strikes, labor disputes, lockdowns, government actions, courier disruptions, or network failures.

Governing Law and Dispute Resolution

Governing law

These Terms are governed by the laws of India, without regard to conflict‑of‑laws principles.

Jurisdiction

Subject to the arbitration clause, courts at [Bengaluru, Karnataka] shall have exclusive jurisdiction.

Arbitration

Any dispute shall be referred to a sole arbitrator appointed under the Arbitration and Conciliation Act, 1996 (as amended). Seat and venue of arbitration: [Bengaluru, Karnataka]. Language: English. Each party bears its own costs unless the award states otherwise. Injunctive relief in court may be sought for IP or misuse.

Termination

We may suspend or terminate access to the Site or cancel orders for violations of these Terms, illegal activity, or risk to our systems or customers. Users may stop using the Site at any time. Sections that by nature should survive termination will survive.

Changes to Terms

We may update these Terms at any time. Changes are effective upon posting on this page with a revised “Last updated” date. Continued use of the Site constitutes acceptance of updated Terms.
